About the Event
This presentation will explore key issues that are relevant for effective estate planning and administration involving persons with disabilities such as:
- Legal versus medical concepts of incapacity and disability
- Substitute decision making
- Guardianship – what is it, how does it work and who can apply?
- Tools for disability planning including: Henson trusts, qualified disability trusts, and registered disability savings plans
- Case study example to illustrate challenges in coordinating planning and administration particularly across multiple family members
- Resources from the Society of Trust and Estate Practitioners related to assisting persons in vulnerable situations
The presentation will also examine themes that are common to estate planning and administration generally for everyone since the presence of a disability is a factor for consideration, but not the only one.
